Q: Does an employee have a right to access their employment record as updated by their employer?

Maybe, although data protection can be a complex issue. The Data Protection Act 1998 applies to personal data in computerised, manual or any other format, and the data needs to be in a system that allows the information to be readily accessible.

Therefore, most personnel and employment files are likely to be covered by the Data Protection Act and your employees have a right to request access. The request must be in writing and a fee of £10 paid in advance. The information must be supplied by you within 40 days.
