Q: Our employee refused to work on scaffolding he was setting up; saying it wasn’t safe. We disagree. He did the site survey & chose the set up. He has worked on the same set up before. We are unsure what action to take; he seems not to want this work.

Is it a full time employee? Assuming he is and everything does fit in with H&S guidelines - so the protests aren't legitimate - then you can start a disciplinary procedure against that person.

Do be careful though as employment legislation is heavily stacked in favour of the employee. Check out this article on SmallBusiness.co.uk on how to avoid an unfair dismissal claim
