Q: Is an employer obligated to provide transport home when public service is not available?

Probably not in most situations, however, there are exceptions. An employer does have a duty of care to their employees and in a pub or club for example, where individuals finish work in the early hours of the morning leaving employees to walk home in such an environment can be somewhat dangerous and it would be sensible for the employer to adopt a suitable policy in such circumstances. It could involve somebody in a manager’s position, or a member of staff, taking people home in either their own transport or a company vehicle; another solution would be to pay for private hire transport. An employer who decides it is not their responsibility to organise staff transport to get home and if, as a result, someone in their employment comes to harm they might come to regret failing to implement such a policy!
