Q: Can we get out of a franchise that we have been in for a year now, on the grounds of mis-selling? We feel the level of support given in the early months was virtually non-existent and this has resulted in the business taking much longer to get up and running and a further £82,000 borrowing.

Whether you can get out of a franchise would really depend of the clauses of the franchise agreement and how vigorous the franchisor is in enforcing it. In view of the circumstances, I would suggest that a meeting with the franchisor would be appropriate with an airing of the main issues (lack of support, mis selling etc). If these are not amicably settled, then a franchise solicitor should be consulted.

Unfortunately situations like this arise commonly. It is likely that the Franchise contract signed will be heavily weighted in the favour of the Franchisor and may even allow for payment by the franchisee of all royalties due under the entire term of the franchise.
