Q: An employee is on sick leave after a planned operation, and recovery is longer than planned. He has used up his three weeks of paid sick leave. What now?

If the employee is fit to return to work then he returns to work as normal. If he is unfit then he will move onto statutory sick pay. If he is seeking to return to work on light or reduced duties then this comes down to agreement.  The employee should be paid the correct rate for the work he does, wherever he does it.  If he is performing his normal work then it should get paid at the normal rate, lower paid work would be paid at the lower rate. It’s the work, not the location that sets the rate of pay
