Q: Can I stop a portion of someone’s pay for damaging a company vehicle?

The answer to this is fairly straightforward because unless you have a signed declaration from the employee ‘in advance’ of the accident that you want compensating for, then the answer is ‘No’, I’m afraid. 

The declaration must state that the employee is prepared to have money stopped from their wages in the event of causing reckless or negligent damage to company property. If you don’t have such a declaration and you make the deduction regardless, then the employee can sue you for making an unlawful deduction from wages.
