Q: If we use student labour and pay them by the job, would they need to be classed as employees?

It depends on a range of factors including the nature and regularity of the work, the level of control and the contracts you enter into.

If they are working on an ad hoc basis as and when you need them, then they are more likely to be considered workers than employees. However, if there is an element of regularity about the work then they are more likely to be seen as employees.

Unfortunately, there is no hard and fast rule on this as it is determined by the specific circumstances and one significant factor will be the nature and length of each individual job.
