Q: One of our staff accepted voluntary redundancy. Notice period is up to 23rd December 2008. She has around 5 weeks of holiday due and we would like her to take this holiday during her notice period. Can we do this?

You cannot force an employee to take this holiday unless your employee’s contract allows for this.

If it doesn’t, you should have a meeting with the employee and attempt to persuade your employee to take some leave during this time. If they insist upon continuing work, there is little you are able to do.
