Q: I need to make my employee redundant. He completed his apprenticeship with me two years ago, does his redundancy pay include the years he spent doing his training?

You need to include all time spent in your employment from the age of 16 when calculating length of service in order to determine the level of any redundancy payment. This will include any time spent employed as an apprentice.

If he started his apprenticeship before he was 16 then you would disregard any time spent when he was under 16. Remember that redundancy is about the post, not the person, so do make sure that you have properly consulted about whether or not this post should go and, if so, whether or not this employee should go before dismissing him as redundant. 

Consider any alternative work he can do and whether or not you should be keeping him in some other role, even if that might involve bumping someone else out, or if there are alternatives such as reduced hours, especially if you have any contractual right to put employees on lay off or short-time working.
