Q) Does an employer have to provide a place to get drinking water and a place to be able to wash up other than a basin used for toilet facilities?

An adequate supply of drinking water should be provided to all employees and should be available from a suitable place and marked appropriately and clearly so that the area can be identified easily. Markings however are not needed if the non-drinkable water supplies are clearly marked. If the basin in the toilet facility is not contaminated in any way then this should be sufficient.

You will also need to provide an adequate amount of cups for your employees to use, or something that the individual can use as a cup. If you have a drinking fountain installed then cups are not needed as the employee can drink safely from this. Drinking water should normally be obtained form a public or private water supply by means of a tap on a pipe connected directly to the water main.

If you cannot supply water from the mains supply the employer should provide a secondary source of drinking water. Provide water in refillable containers suitably enclose the source to avoid contamination of any kind. The container should be refilled daily at least, to reduce the risk of contamination.

Installing drinking water taps where they are likely to become contaminated should be avoided, for example in a factory where lead is handled or processed. As far as reasonably possible the taps should be installed in sanitary accommodation, such as a canteen area, separated from the factory floor. Following common sense with drinking water is usually key with this area.
